Famwisely, Inc., a Utah corporation dba ParentPlaybook (“ParentPlaybook”, “us”, “we”, or “our”) operates the https://www.parentplaybook.com/ website and ParentPlaybook app (hereinafter collectively referred to as the “Service”).

This page informs you of our policies regarding the collection, use and disclosure of personal data when you use our Service and the choices you have associated with that data.  ParentPlaybook intends to provide you with a level of comfort and confidence in how we collect, use, share, and safeguard information that we collect.  This Privacy Policy also explains how you can contact us if you have any questions or concerns.  

We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms of Use, accessible from https://www.parentplaybook.com/

Definitions

  • Service: Service is the https://www.parentplaybook.com/ website and the ParentPlaybook app.  
  • Personal Data: Personal Data means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).
  • Usage Data: Usage Data is data collected automatically either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • Cookies: Cookies are small files stored on your device (computer or mobile device).

Information Collection and Use

We collect several different types of information for various purposes to provide and improve our Service to you.

Types of Data Collected

Personal Data

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to:

  • Email address
  • Name
  • Date of Birth
  • Zip Code
  • Gender
  • Special Needs
  • Family members names and date of birth
  • Contact phone number
  • Other social media accounts
  • Cookies and Usage Data

We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or the instructions provided in any email we send.

Correcting or Updating Personal Data

We rely on the personal information that you give us, so it is important that all of the details that you give to us are accurate and up-to-date.  If your personal information changes, please update your personal information in the app.  If you need assistance updating your personal information, please contact us at admin@parentplaybook.com. 

Usage Data

We may also collect information on how the Service is accessed and used (“Usage Data”). This Usage Data may include information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

Tracking & Cookies Data

We use cookies, analytics and other tracking technologies to track and analyze the activity on our Service and we hold certain information. 

Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Other tracking technologies are also used such as beacons, tags and scripts to collect and track information and to improve and analyze our Service.

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service.

Examples of Cookies we use:

  • Session Cookies. We use Session Cookies to operate our Service.
  • Preference Cookies. We use Preference Cookies to remember your preferences and various settings.
  • Security Cookies. We use Security Cookies for security purposes.

At this time, we do not respond to Web browser “do not track” signals. 

Interactions with us

We may record, analyze and use your interaction on our Service for improving our interactions with you and others.  

Use of Data

ParentPlaybook uses the collected data for various purposes:

  • To provide and maintain our Service
  • To notify you about changes to our Service
  • To allow you to participate in interactive features of our Service when you choose to do so
  • To provide customer support
  • To gather analysis or valuable information so that we can improve our Service
  • To monitor the usage of our Service
  • To detect, prevent and address technical issues
  • To provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information

Transfer of Data

Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

If you are located outside United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to United States and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

ParentPlaybook will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

Disclosure of Data

Business Transaction

If ParentPlaybook is involved in a merger, acquisition or asset sale, your Personal Data may be transferred to our successor in interest. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.

Legal Requirements

ParentPlaybook may disclose your Personal Data in the good faith belief that such action is necessary to:

  • To comply with a legal obligation
  • To protect and defend the rights or property of ParentPlaybook
  • To prevent or investigate possible wrongdoing in connection with the Service
  • To protect the personal safety of users of the Service or the public
  • To protect against legal liability

Security of Data

You use the Service at your own risk. The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

Deletion of Data

You have control over your data, including what data is retained and what data is deleted.  At any time, you can request all or part of your data to be deleted by sending an email to remove@parentplaybook.com.  ParentPlaybook will delete your data within seven (7) days of receipt of your request. You can also request that only certain data to be deleted by sending an email to remove@parentplaybook.com with details of the data deletion request (type of data to be delete, timeframe of deletion, etc).

You may also delete your Personal Data by deleting your account through the App under account settings.  When you delete your Personal Data, we will store a backup of your Personal Data for thirty (30) days before it is permanently removed from our servers.  

Third Party Service Providers

We may disclose, share, or make available your Personal Data with our third-party service providers, business partners, and other third parties (“Service Providers”) to facilitate or improve the Service, provide parts of the Service on our behalf, perform Service-related services, or assist us in analyzing how our Service is used. Pursuant to our instructions, these Service Providers will access, process, or store Personal Information in the course of performing their duties to us.

Currently we use the following third party services and Service Providers: Google Analytics, UXCam, OpenAI and Algolia.  

With your permission, we may also pull Personal Data from third-party sites and apps, including: Instagram, TikTok, Pinterest, YouTube, Spotify, Diffbot, Unsplash and Facebook.

Health Care Professionals

Through our Service, you may connect with medical professionals, mental health professionals, life coaches and other health care professionals that use ParentPlaybook (“Health Care Professionals”).  Our Service is not designed to exchange personal and confidential health related information.  While we do not regularly monitor your messages exchanged through the messaging platform, these messages can be accessed by us to ensure that our users are safe from bullying, threats and intimidation from other users.  If you decide to engage the services of one of the Health Care Professionals on ParentPlaybook, you will be directed to a HIPAA compliant telehealth service so that any private health care information can be safely and securely exchanged.  

Links to Other Sites

Our Service may contain links to other sites that are not operated by us. If you click a third party link, you will be directed to that third party’s site. The information that you share with each third-party site will be governed by the privacy policy and terms of use of the third party for that site, not by this Privacy Policy. We strongly advise you to review the privacy policy of every site you visit.

We do not endorse or make any representations or warranties concerning, and will not in any way be liable for, any informational content, products, services, software, or other materials available on other websites, even if one or more pages of the other websites are framed within, or linked to, a page of our website.

Children’s Privacy

Our Service is not directed to children who are under the age of 13. People under the age of 13 should not use this service. Any information collected is for internal use only and will not be distributed. Parents may at any time contact us to remove their child’s information from our records. If you have reason to believe that a child under the age of 13 has provided Personal Information to ParentPlaybook through the Service please email us at support@parentplaybook.com and we will endeavor to delete that information from our databases.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will post any changes on this page and may also provide notice of material changes to our Privacy Policy on our website home page or through our Service.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page. If you object to any changes to this Privacy Policy, you may discontinue use of our website and services. Each time you use our Service, you agree that the current version of this Privacy Policy applies.

Famwisely, Inc., a Utah corporation dba ParentPlaybook (“ParentPlaybook”, “us”, “we”), provides parents and families with a family friendly social media experience.  These Terms of Use (the “Terms”) govern your use of our ParentPlaybook software application and the other products, features, apps, services, technologies, and software we offer (collectively, the “Products” or “Playbook”), except where we expressly state that separate terms (and not these) apply.  

Services we provide

Our mission is to give parents a family friend community and to connect them with resources to enhance and support their families.  To help advance this mission, we provide the Products and services described below to you:

Your experience on ParentPlaybook is unique.  You chose the content you see on your Playbook.  We help you find and connect with people, groups, businesses, organizations, professionals and others that matter to you across the ParentPlaybook Products you use.  We believe it takes a village to raise a family and that good families create good communities.  We believe our services are most useful when people are connected to people, groups, and organizations they care about.

There are many ways to express yourself on ParentPlaybook and to communicate with friends, family, and other collaborators about what matters to you – for example, sharing and posting to your individual Playbook, collaborating with other users on their Playbooks, or sending messages to a friend or professional. 

Our messaging service is provided to connect you with others, but it is not provided to exchange personal confidential health care information.  Our messaging service can be used to help you connect with medical professionals, mental health professionals, life coaches and other health care professionals that use ParentPlaybook (“Health Care Professionals”).  However, if you decide to engage the services of one of the Health Care Professionals on ParentPlaybook, you will be directed to a HIPAA compliant telehealth service so that any private health care information can be safely and securely exchanged.  

Protect our community

ParentPlaybook is designed to provide a safe online space for you.  People will build a community on ParentPlaybook if they feel safe. We allow users to detect and report the misuse of ParentPlaybook, including, harmful conduct towards others, bullying, and situations where we may be able to help support or protect our community. If we learn of content or conduct like this, we will take appropriate action – for example, offering help, removing content, removing or restricting access to certain features, disabling an account, or contacting law enforcement.

Your commitments to ParentPlaybook and our community

We provide these services to you and others to help advance our mission. In exchange, we need you to make the following commitments:

  • You will treat others’ opinions and actions with respect.
  • You will not demean or bully other users.
  • You will not post any pornographic content.

We try to make Parent Playbook broadly available to everyone, but you cannot use ParentPlaybook if:

  • You are under 13 years old.
  • You are a convicted sex offender.
  • We’ve previously disabled your account for violations of our Terms or Policies.
  • You are prohibited from receiving our products, services, or software under applicable laws.

We want people to use ParentPlaybook to express themselves, to create and to share content that is important to them, but not at the expense of the safety and well-being of others or the integrity of our community. You therefore agree not to engage in the conduct described below (or to facilitate or support others in doing so):

  • You may not use ParentPlaybook to do or share anything:
  • That violates these Terms and other terms and policies that apply to your use of ParentPlaybook.
  • That is unlawful, misleading, discriminatory or fraudulent.
  • That infringes or violates someone else’s rights, including their intellectual property rights.
  • You may not upload viruses or malicious code or do anything that could disable, overburden, or impair the proper working or appearance of our Products.
  • You may not access or collect data from our Products using automated means (without our prior permission) or attempt to access data you do not have permission to access.

We can remove or restrict access to content that is in violation of these provisions.

To help support our community, we encourage you to report content or conduct that you believe violates your rights (including intellectual property rights) or our terms and policies.

We also can remove or restrict access to your content, services or information if we determine that doing so is reasonably necessary to avoid or mitigate adverse legal or regulatory impacts to ParentPlaybook.

We reserve all rights to terminate accounts, edit or remove content at our sole discretion.

Conditions of use

By using our Products, you certify that you have read and reviewed and agree to comply with these Terms.  If you do not want to be bound by these Terms, do not use ParentPlaybook. ParentPlaybook only grants use and access of the Products to those who have accepted these Terms.

Privacy policy

Before you continue using ParentPlaybook, we advise you to read our Privacy Policy regarding how we collect and use your personal data. 

Applicable law

By using our ParentPlaybook, you agree that the laws of the State of Utah, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might arise between ParentPlaybook and you, or our business partners and associates.

For any claim, cause of action, or dispute you have against us that arises out of or relates to these Terms or ParentPlaybook, you agree that it will be resolved exclusively in the state courts located in the State of Utah, Utah County.  You also agree to submit to the personal jurisdiction of the state courts of Utah for the purpose of litigating any such claim.

Indemnification

You agree to indemnify ParentPlaybook and its affiliates and hold us harmless against legal claims and demands that may arise from your use or misuse of ParentPlaybook.  We reserve the right to select our own legal counsel.

No warranties; Limitation on liability

We work hard to provide the best Products we can and to specify clear guidelines for everyone who uses them. Our Products, however, are provided “as is,” and we make no guarantees that they always will be safe, secure, or error-free, or that they will function without disruptions, delays, or imperfections. To the extent permitted by law, we also DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not control or direct what people and others do or say, and we are not responsible for their actions or conduct (whether online or offline) or any content they share (including offensive, inappropriate, obscene, unlawful, and other objectionable content).

One of the features of the Product is an AI (artificial intelligence) parenting assistant called “Sophie” that can respond to questions through the Product’s chat feature. While this AI chat feature provides a valuable and helpful function to users, we cannot guarantee that all information provided by it will be correct and error-free. YOU SPECIFICALLY AGREE THAT YOUR USE OF THIS AI CHAT FUNCTION IS SUBJECT TO ALL OF THE DISCLAIMERS AND LIMITATIONS IN THIS SECTION. 

ADVICE AND CONTENT PROVIDED BY US THROUGH THE PRODUCT, INCLUDING ITS AI CHAT FEATURE, IS FOR INFORMATIONAL PURPOSES ONLY. THE PRODUCT IS NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL MEDICAL OR OTHER ADVICE, DIAGNOSIS OR TREATMENT. ALWAYS CONSULT A QUALIFIED PROFESSIONAL FOR ADVICE, DIAGNOSIS, AND TREATMENT OF ANY SIGNIFICANT CONCERNS. YOUR USE OF THE PRODUCT IS AT YOUR SOLE RISK, AND YOU AGREE THAT PARENTPLAYBOOK IS NOT RESPONSIBLE OR LIABLE FOR ANY ISSUES OR PROBLEMS, MEDICAL OR OTHERWISE, THAT MAY ARISE IN CONNECTION WITH YOUR USE OF THE PRODUCT. 

OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND UNDER NO CIRCUMSTANCE WILL WE BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, EXEMPLARY, PUNITIVE, OR INCIDENTAL DAMAGES, OR FOR ANY PERSONAL INJURY, DEATH, COSTS OR EXPENSES, LOST PROFITS OR REVENUE, OR LOST INFORMATION OR OR DATA, ARISING OUT OF OR RELATED TO THESE TERMS OR THE PARENTPLAYBOOK PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE PARENTPLAYBOOK PRODUCTS AND SERVICES WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS.  PARENTPLAYBOOK IS NOT LIABLE FOR ANY DAMAGES THAT MAY OCCUR TO YOU AS A RESULT OF YOUR MISUSE OF OUR PRODUCTS AND SERVICES.

General terms

We offer the Product from our location in the United States of America. We make no representation that the Product or any of our services are appropriate or available for use in other locations, and use thereof in jurisdictions or territories where their content is illegal is prohibited. Our provision of our Products and services is subject to existing laws and legal processes. Nothing in these Terms limits our right to comply with governmental, court, and law enforcement requests or requirements.

Unless otherwise specified herein, these Terms constitute the entire agreement between you and us with respect to our Products and services and supersedes all other prior or contemporaneous communications and understandings, whether electronic, oral, or written, between you and us with respect to such Products and services. If any provision of these Terms is found void or unenforceable, all other provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not constitute a waiver of our right to enforce that right or provision in the future.
